Binding Agreement Child Support

 

Child support is a monetary donation provided from one or both parents to the other to assist with the costs of child care.

Parents may make a legally enforceable agreement on the number, frequency, and form of binding agreement child support payments after the divorce if they consent.

There are two types of child support agreements:

·        limited agreements

·        binding agreements.

Child maintenance arrangements are not anything to take lightly. They are legally binding financial arrangements that can only be modified by a potential agreement between you and the other parent or by filing a complex application with the Federal Circuit Court. Making a child support agreement

You and the other parent will make a legally enforceable child support arrangement if you and the other parent agree to how your child should be financially assisted.

The number, frequency, and form of binding agreement child support are all specified in writing in child support agreements. Child maintenance arrangements ensure that the child receives adequate financial support from both parents.

There are two types of child support agreements:

·        limited agreements

·        binding agreements.

 

Limited child support agreement

A restricted child support agreement (limited agreement) is a written contract between both parents that specifies the number, frequency, and method of child support payments.

Before entering into a limited agreement, you should seek legal advice from Eckert Legal team.

To make a limited agreement:

There must be a system in place for managerial evaluation.

Child support payments must be equal to or greater than the assessment under the agreement.

The agreement can be ended:

·        by entering into another restricted or legally binding child support agreement.

·        if both parents sign a written agreement.

·        if the theoretical evaluation shifts by more than 15% (then either parent can choose to end the limited agreement).

·        after 3 years, by either parent.

·        as a result of a court order.

Binding child support agreement

A contractual child support agreement (binding agreement) is a written agreement signed by both parents that specify the number, frequency, and system of payments for their children.

A definitive agreement, unlike a limited agreement, may be made and approved even though no child support assessment has been completed. It can be made for any amount agreed upon by both parents. It may be less than, equal to, or greater than the administratively assessed child support rate.

To make a binding agreement:

·        Both parents must seek professional legal counsel on the benefits and drawbacks of signing the contract.

·        Each parent's lawyer must sign a certificate indicating that legal advice was given.

·        The agreement must include the lawyer's certificates.

The agreement can be ended:

·        in writing by both parents

·        by making another binding agreement

·        by a court order.
